Guidance from IRS May Make In-plan Roth Conversions Easier

While the 2012 American Taxpayer Relief Act made it possible for plans to allow participants to convert all vested pre-tax amounts to a Roth account, many plan sponsors were tentative about changing plan rules to allow these conversions. New guidance from the Internal Revenue Service offers clarifications for 401(k), 403(b), and governmental 457 plans that may make Roth conversions more accessible.

The Department of Labor's (DOL) Employee Benefit Security Administration (EBSA) issued Field Assistance Bulletin No. 2013-02 on July 22, 2013, giving plan sponsors and administrators a little extra time to comply with the deadline for delivery of certain annual participant fee disclosures.

Retirement Plans Catch the Attention of Congress (Again)

The Secure Annuities for Employee (SAFE) Retirement Act of 2013 is the latest attempt by lawmakers to address the retirement crisis in America. Senate Finance Committee Ranking Member Orrin Hatch (R-Utah) introduced the bill with the intention of helping to strengthen America's public and private retirement systems. "These are common-sense and long-overdue reforms to our nation's savings laws," Hatch explained in describing his proposed law on the Senate floor. The bill addresses three main areas of reform:

The Supreme Court Defense of Marriage Act decision — how are ERISA plans affected?

The Supreme Court decided on June 26 that Section 3 of the federal Defense of Marriage Act (DOMA) was unconstitutional. Section 3 of DOMA defined marriage for federal law purposes to mean opposite-sex marriage.

Survey Says: Helping Employees Helps Employers

According to a new participant survey by J.P. Morgan Asset Management, 43 percent of participants intend to "wing it" in retirement, "planning to figure out how to live off of whatever they have saved when they decide to retire." While this is not the only disturbing statistic to come out of the survey, it's hard to be surprised anymore to learn about American workers' unpreparedness for retirement.

Lifetime Income Illustration: the Department of Labor's Advance Notice of Proposed Rulemaking

The Employee Benefits Security Administration (EBSA), an agency of the Department of Labor, believes that "illustrating an account balance as a lifetime income stream will help workers in defined contribution plans to better prepare for retirement." For this reason, the agency has issued an "advance notice of proposed rulemaking" (ANPRM) requesting comments on whether (and how) an estimated lifetime income stream could be illustrated on participant statements.

PBS Frontline's recent episode on the defined contribution retirement industry pulled no punches. By highlighting a series of real-life people who have suffered significant losses in their retirement savings, Martin Smith, the episode's producer, put the spotlight on hidden and high fees, conflicts of interest, and stock market risk as being at the core of what he called America's retirement crisis.
